EU AI Act Overview<\/strong><\/p>\n\n\n\n

Here’s how the Act regulates different types of AI systems, with examples:<\/p>\n\n\n\n

1. Unacceptable Risk AI Systems<\/h3>\n\n\n\n

These are AI systems whose risks cannot be mitigated and are thus banned. Examples include:<\/p>\n\n\n\n

  • Manipulative AI<\/strong>: Systems that use cognitive behavioral techniques to exploit vulnerabilities in specific groups, such as children, and manipulate their behavior.<\/li>\n\n\n\n
  • Social Scoring<\/strong>: AI that assesses individuals based on their behavior, socio-economic status, or other personal characteristics for social scoring purposes.<\/li>\n\n\n\n
  • Real-time Biometric Identification<\/strong>: Certain uses of real-time and remote biometric identification, such as facial recognition in public spaces, are prohibited, except under strict conditions for law enforcement.<\/li>\n<\/ul>\n\n\n\n

    2. High-Risk AI Systems<\/h3>\n\n\n\n

    These AI systems affect safety or fundamental rights and are subject to stringent requirements. Examples include:<\/p>\n\n\n\n

    • Biometric Categorization<\/strong>: Systems used for identifying or categorizing natural persons using biometrics.<\/li>\n\n\n\n
    • AI in Critical Infrastructure<\/strong>: Systems managing and operating critical infrastructure, such as energy grids or transport networks.<\/li>\n\n\n\n
    • AI in Education and Employment<\/strong>: Systems used in education and vocational training, or for employment, worker management, and access to self-employment.<\/li>\n\n\n\n
    • Law Enforcement AI<\/strong>: Systems used in law enforcement, migration, asylum, and border control management.<\/li>\n<\/ul>\n\n\n\n

      These systems must undergo pre-market assessments, continuous post-market monitoring, and compliance with strict transparency and data management standards.<\/p>\n\n\n\n

      3. Limited Risk AI Systems<\/h3>\n\n\n\n

      AI systems posing limited risks must meet specific transparency obligations. For instance:<\/p>\n\n\n\n

      • Chatbots<\/strong>: Users should be informed that they are interacting with an AI (not a human) when using chatbots for customer service or other applications.<\/li>\n\n\n\n
      • AI-Generated Content<\/strong>: Generative AI systems, like those creating artwork or writing, must disclose that the content was AI-generated.<\/li>\n<\/ul>\n\n\n\n

        4. Minimal or No-Risk AI Systems<\/h3>\n\n\n\n

        These are AI applications with minimal or no risk, such as AI-enabled video games or spam filters. They are subject to minimal or no additional regulation under the AI Act.<\/p>\n\n\n\n

        General Provisions<\/h3>\n\n\n\n

        • Transparency<\/strong>: All AI systems, particularly those in high-risk categories, must be transparent about their capabilities and limitations.<\/li>\n\n\n\n
        • Data Governance<\/strong>: The Act emphasizes responsible data management, ensuring that AI systems use high-quality, non-discriminatory data sets to reduce biases.<\/li>\n\n\n\n
        • Human Oversight<\/strong>: Systems should be designed to allow meaningful human oversight, preventing AI from making unreviewable decisions, especially in critical applications.<\/li>\n<\/ul>\n\n\n\n

          Enforcement and Penalties<\/h3>\n\n\n\n

          The AI Act enforces its regulations through penalties for non-compliance, which can be substantial. For example, fines can reach up to \u20ac35 million or 7% of the global turnover for serious infringements, such as deploying banned AI systems.<\/p>\n\n\n\n

          Support for Innovation<\/h3>\n\n\n\n

          The Act also promotes innovation, especially for SMEs, by establishing regulatory sandboxes for testing AI innovations in real-world environments under regulatory supervision.<\/p>\n\n\n\n
