Unacceptable Risk AI Systems

These are AI systems whose risks cannot be mitigated and are thus banned. Examples include:

Manipulative AI: Systems that use cognitive behavioral techniques to exploit vulnerabilities in specific groups, such as children, and manipulate their behavior.

Social Scoring: AI that assesses individuals based on their behavior, socio-economic status, or other personal characteristics for social scoring purposes.

Real-time Biometric Identification: Certain uses of real-time and remote biometric identification, such as facial recognition in public spaces, are prohibited, except under strict conditions for law enforcement.

2. High-Risk AI Systems

These AI systems affect safety or fundamental rights and are subject to stringent requirements. Examples include:

Biometric Categorization: Systems used for identifying or categorizing natural persons using biometrics.

AI in Critical Infrastructure: Systems managing and operating critical infrastructure, such as energy grids or transport networks.

AI in Education and Employment: Systems used in education and vocational training, or for employment, worker management, and access to self-employment.

Law Enforcement AI: Systems used in law enforcement, migration, asylum, and border control management.

These systems must undergo pre-market assessments, continuous post-market monitoring, and compliance with strict transparency and data management standards.

3. Limited Risk AI Systems

AI systems posing limited risks must meet specific transparency obligations. For instance:

Chatbots: Users should be informed that they are interacting with an AI (not a human) when using chatbots for customer service or other applications.

AI-Generated Content: Generative AI systems, like those creating artwork or writing, must disclose that the content was AI-generated.

4. Minimal or No-Risk AI Systems

These are AI applications with minimal or no risk, such as AI-enabled video games or spam filters. They are subject to minimal or no additional regulation under the AI Act.

General Provisions

Transparency: All AI systems, particularly those in high-risk categories, must be transparent about their capabilities and limitations.

Data Governance: The Act emphasizes responsible data management, ensuring that AI systems use high-quality, non-discriminatory data sets to reduce biases.

Human Oversight: Systems should be designed to allow meaningful human oversight, preventing AI from making unreviewable decisions, especially in critical applications.

Enforcement and Penalties

The AI Act enforces its regulations through penalties for non-compliance, which can be substantial. For example, fines can reach up to €35 million or 7% of the global turnover for serious infringements, such as deploying banned AI systems.

Support for Innovation

The Act also promotes innovation, especially for SMEs, by establishing regulatory sandboxes for testing AI innovations in real-world environments under regulatory supervision.

The EU’s AI Act represents a comprehensive attempt to balance the promotion of AI innovation with the need to protect public interests and fundamental rights. Its risk-based approach allows for the nuanced treatment of AI systems, ensuring that higher-risk applications are subject to more rigorous scrutiny and regulation.

EU AI Act Overview The European Union’s new Artificial Intelligence Act introduces a regulatory framework that categorizes AI systems based on their risk levels and applies corresponding regulations.
